By accessing and using our website ("Site") and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

Our Site is a comprehensive dispatch and operations platform tailored to pilot car and transportation businesses. It provides tools for dispatch management, client and driver records, vehicle maintenance tracking, HR functions, timecards, payroll calculations (gross pay only), announcements, and invoicing. Companies can assign work to drivers, and drivers/employees can use the portal to complete dispatch tasks, view payroll summaries, track time, and review assigned vehicles. Some functionality includes AI-assisted tools to streamline tasks such as vehicle repair order parsing and client detail entry.

The operations software is free. Optional online invoice payments carry the platform fee described below and are processed through Stripe. We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice.

• Pilot Car Pros operations software is free for owner-operators and fleets. There are no monthly, driver-seat, or storage subscription charges.
• You are responsible for providing accurate business, billing, and contact information.
• Online invoice payments: Payments processed through PCP carry one flat 5% payment fee, including card processing. PCP covers Stripe processing costs from this fee and keeps the remainder to support the free software. The company pays the fee by default and can choose to pass it to card-paying clients in payment settings. When passed to the client, the fee appears as a separate checkout line and is included in the total shown before payment.
• Stripe provides payment processing and connected-account onboarding under its applicable terms. Companies remain responsible for their services, invoice accuracy, client authorizations, and resolving payment disputes. Payment confirmation and payout availability are separate; payouts depend on connected-account requirements and Stripe processing schedules.
• Card processing is included in the stated 5% payment fee. A company may instead add a 3% client fee for card payments, covering part of its 5% fee. The 3% card option and full 5% option cannot be used together. Both client-fee options apply only to card payments. ACH payments have no added client fee. Any fee passed to the client must be disclosed before payment and permitted for that transaction.
• ACH bank payments are available for eligible U.S. connected accounts. They may take several business days to confirm; a submitted or processing payment is not yet a paid invoice.

• Data that is displayed publicly on our Site is shared publicly for the purpose of showcasing pilot car services.
• We share internal information with authorized personnel and service providers as described in our Privacy Policy, including the data needed to process online payments.
• Our privacy policy, which is incorporated by reference into these Terms, explains how we collect, use, and protect your information.

• You are solely responsible for the content you submit for display on our Site.
• You agree to provide accurate and up-to-date information.
• You will not submit any content that is unlawful, defamatory, or that infringes on the rights of any third party.

• All content provided on our Site, including trademarks, logos, and other proprietary materials, is the property of our company or our licensors.
• You are granted a limited, non-exclusive, and non-transferable license to access and use the Site for personal, non-commercial purposes, except as expressly permitted under these Terms.

• Our services are provided "as is" without any warranties of any kind.
• We do not guarantee that the Site will be error-free, secure, or uninterrupted.

• To the fullest extent permitted by law, our company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our Site or services.
• This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

You agree to indemnify, defend, and hold harmless our company and its affiliates from any claims, losses, liabilities, damages, or expenses arising out of your use of the Site, your violation of these Terms, or your infringement of any rights of any third party.

• These Terms shall be governed by and construed in accordance with the laws of the State of Alaska, without regard to its conflict of laws principles.
• Any disputes arising out of these Terms shall be resolved through binding arbitration in accordance with the applicable rules.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be severed, and the remaining Terms shall remain in full force and effect.

We reserve the right to update or modify these Terms at any time. Continued use of our Site following any changes constitutes your acceptance of the revised Terms.
